Terms of Service

These Terms of Service (“Terms”) form a binding agreement between you (“you,” “Customer”) and NativeFoundation, Inc., a Delaware corporation with its registered office at 131 Continental Drive, Suite 305, Newark, DE 19713, USA (“NativeFoundation,” “we,” “us,” or “our”), governing your access to and use of doesaichooseyou.com and the AI Visibility Audit reports we provide (collectively, the “Service”).

By using the Service or purchasing a report, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

DoesAIChooseYou? produces an “AI Visibility Audit” by submitting buyer-intent queries to third-party large-language-model APIs and analyzing the responses for the presence, ranking, and framing of your brand. The output is a report containing scores, model-by-model breakdowns, and recommendations.

The Service does not modify how any AI system actually behaves. The report is informational only.

2. Eligibility and accounts

You must be at least 18 years old and able to enter into a binding contract. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization, and “you” refers to both you and that organization.

You are responsible for keeping your account credentials confidential and for all activity under your account. Notify us at support@doesaichooseyou.com of any unauthorized use.

3. Orders, fees, and payment

A single AI Visibility Audit report is priced at $99 USD, £99 GBP, or €99 EUR, depending on your billing location as detected by Stripe at checkout. The price shown to you at checkout is the price you pay for that order.
The fee is charged once at the time of purchase. There is no subscription or recurring charge.
Payments are processed by Stripe. By providing payment information, you authorize us and Stripe to charge the applicable amount, including any taxes or duties required by your jurisdiction.
Currency is determined at checkout and cannot be changed after purchase. Refunds (where applicable under Section 4) are issued in the original currency charged.
Prices may change for future purchases; the price in effect at the time of your order applies to that order.

4. Refunds

Because the Service is a one-time digital deliverable that consumes paid third-party AI API calls at the moment of generation:

Once a report has been generated, fees are non-refundable.
If we are unable to deliver your report due to a technical failure on our side, contact us at support@doesaichooseyou.com within 14 days and we will either re-run the report or refund the order in full at our option.
Nothing in this section limits any non-waivable consumer rights you may have under your local law.

5. License and acceptable use

We grant you a limited, non-exclusive, non-transferable, revocable license to access the Service and to use the report we deliver to you for your own internal business purposes, including sharing it inside your organization and with your direct advisors. You may not:

Resell, sublicense, or redistribute the report or any substantial portion of it as a standalone product.
Use the Service to scrape, reverse engineer, or train competing products.
Submit queries that target individuals (rather than brands or businesses) in a way that would be defamatory, harassing, or unlawful.
Submit content you do not have the right to submit, or that infringes another party’s rights.
Interfere with the Service’s operation, attempt to bypass rate limits, or probe for vulnerabilities without prior written consent.
Use the Service in a way that would cause us to violate any third-party AI provider’s terms of use.

We may suspend or terminate your access for material breach of these Terms.

6. Customer content and grant

“Customer Content” means the brand names, competitor names, URLs, queries, and other information you submit. You retain all rights in Customer Content. You grant us a worldwide, royalty-free, non-exclusive license to use, store, transmit, and process Customer Content solely to operate the Service and produce your report — including transmitting it to the third-party AI providers identified in our Privacy Policy.

You represent that you have the right to submit Customer Content and that doing so does not violate any law or third-party right.

7. Reports and accuracy

The reports describe the output of probabilistic third-party AI models at a particular moment in time. AI models change frequently and produce different results across queries, sessions, and providers. Reports are informational only and are not guarantees of future model behavior, search rankings, sales, or business outcomes. You are responsible for any decisions you make based on a report.

We do not warrant that any third-party AI model will continue to be available, will return consistent results, or that any provider’s terms will remain unchanged.

8. Intellectual property

The Service, including its software, design, methodology, scoring framework, and report templates (excluding your Customer Content), is owned by NativeFoundation and protected by intellectual property laws. Except for the license granted in Section 5, no rights are transferred to you.

You may quote brief excerpts of a report externally with attribution to “DoesAIChooseYou? by NativeFoundation, Inc.”

9. Third-party services

The Service relies on third-party AI providers (OpenAI, Anthropic, Google, Perplexity, DeepSeek, Moonshot, and others as listed in our Privacy Policy). Their availability, output, and terms are outside our control. We are not responsible for any third-party service’s acts or omissions.

10. Disclaimer of warranties

The service and the reports are provided “as is” and “as available”, without warranty of any kind, whether express, implied, or statutory, including without limitation any warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted operation. Some jurisdictions do not allow the exclusion of implied warranties, in which case the above exclusions may not apply to you.

11. Limitation of liability

To the maximum extent permitted by law:

(a) Neither party will be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, even if advised of the possibility of such damages.

(b) Our total aggregate liability arising out of or relating to these Terms or the Service will not exceed the greater of (i) the amount you paid us in the 12 months preceding the event giving rise to liability or (ii) USD $100 (or its equivalent in the currency you were charged).

These limits apply regardless of the legal theory and even if a remedy fails of its essential purpose.

12. Indemnification

You will defend, indemnify, and hold harmless NativeFoundation and its officers, directors, employees, and agents from and against any third-party claim arising out of (a) your Customer Content, (b) your breach of these Terms, or (c) your unlawful use of the Service.

13. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Service. Sections that by their nature should survive (including Sections 6, 7, 8, 10, 11, 12, 14, 15, 16, and 17) will survive termination.

14. Governing law and dispute resolution

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. The parties consent to the exclusive jurisdiction of the state and federal courts located in New Castle County, Delaware for any dispute that is not subject to arbitration or small-claims court.

If you are a consumer in a jurisdiction whose laws give you the right to bring proceedings in your local courts, this section does not override that right.

15. Changes to the Terms or Service

We may update these Terms from time to time. If we make material changes, we will notify you by email or a notice on the Service at least 14 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance.

We may modify, suspend, or discontinue any part of the Service at any time, but if we discontinue a paid feature you have already purchased and not received, we will refund the unused portion.

16. Miscellaneous

Entire agreement. These Terms and the Privacy Policy form the entire agreement between you and NativeFoundation regarding the Service.
Severability. If any provision is found unenforceable, the remaining provisions stay in effect.
No waiver. Failure to enforce any provision is not a waiver of our right to enforce it later.
Assignment. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or asset sale.
Force majeure. Neither party is liable for delays caused by events outside its reasonable control.
Notices. Legal notices to us must be sent to legal@doesaichooseyou.com with a copy to NativeFoundation, Inc., Attn: Legal, 131 Continental Drive, Suite 305, Newark, DE 19713, USA.
